Today we’ve seen Biden repeating his attacks on liberals for “whining” too much, Dear Leader  scolding his drones “inexcusable” lack of enthusiasm, now SEIU’s former chief goon and close Obama ally is under investigation by the FBI, it’s shaping up to be one hell of a day!… WASHINGTON — People interviewed by federal agents report the FBI and the Labor Department are investigating prominent labor leader Andy Stern as part of a corruption probe involving the Service Employees International Union. Two organized labor officials met with federal agents this summer to answer questions about Stern’s role in approving money to pay the salary of an SEIU leader in California who performed no work and a book contract that Stern landed in 2006. Both officials spoke on condition of anonymity because of the sensitive nature of the investigation. Stern abruptly resigned as president of the 2.2-million member SEIU in April.

A federal jury convicted Governor Rod Blagojevich yesterday of one single count, remaining undecided on the other 23. And for that one guilty charge, we can thank Justice Scalia. No, Justice Scalia had nothing to do with the Blagojevich case. But in a way, he had everything to do with it. Governor Blagojevich was convicted of making false statements to federal agents. He told the FBI that he did not track campaign contributions and kept a “firewall” between his campaign and his official duties as Governor. In other words, federal agents asked him if he broke the law — and just like any child who is caught with his hand in the cookie jar — he said “no.” Before 1998, this decision might have been different. Until then, federal courts routinely excused people for what they called the “exculpatory no.” If a federal agent came to your house and asked if you did something illegal, and you said “no,” you were off the hook for making false statements.

[Posted by Karl] Rule Number One: Don’t talk to Fitz : A federal jury found former Illinois Gov. Rod Blagojevich guilty on Tuesday of one count of lying to federal agents, and the judge said he intends to declare a mistrial on the remaining counts. Prosecutors said immediately after the verdict was read that they intend to retry the case against Blagojevich and his co-defendant brother as soon as possible. At least Blago won’t be collecting his public pension (iirc). Nathan Wurtzel reminds me via Twitter: “I killed him, I killed him, I killed him dead .”  Discuss amongst yourselves. –Karl UPDATE BY PATTERICO: Looks like it was an 11-1 hang for guilt on the remaining counts. All it takes is one crazy juror. UPDATE BY KARL: It was 11-1 on the charge of trying to sell the Senate seat vacated by Obama, but the jury foreman adds that there were “often several holdouts on various counts.”
