		<description><![CDATA[ Interesting ; and a pretty strong reversal from Saturday&#8217;s statement . “I obviously feel very strongly that Virginia needs to change its ballot access requirements for our statewide elections,” Cuccinelli said in a statement. “However, after working through different scenarios with Republican and Democratic leaders to attempt to make changes in time for the 2012 presidential election, my concern grows that we cannot find a way to make such changes fair to the Romney and Paul campaigns that qualified even with Virginia&#8217;s burdensome system. “A further critical factor that I must consider is that changing the rules midstream is inconsistent with respecting and preserving the rule of law &#8212; something I am particularly sensitive to as Virginia&#8217;s attorney general.” A blow to every campaign that isn&#8217;t Romney&#8217;s or Paul&#8217;s, of course. 		<description><![CDATA[ Virginia Attorney General Ken Cuccinelli came away from this weekend's Huckabee presidential forum, mentioned by Aaron, unimpressed with Newt Gingrich and Mitt Romney. Of Gingrich, Cuccinelli, one of three attorney generals to lob questions at the forum, said after the event: "My benchmark was I want to leave with comfort that each of these six candidates is going to be a limited government conservative president. And despite pressing Newt Gingrich several times, I didn't get that. I did not get that. We could have another compassionate conservative on our hands. I did not get that commitment." And of Romney: "I don't see a lot of distance there between him and the president." Cuccinelli repeated those criticisms in subsequent interviews, calling Romneycare "Obamacare light" and saying that "elements" of Gingrich's congressional record are "anything but conservative." The Virginia attorney general is a leader in the legal fight against Obamacare and recently announced he will be running for governor. Cuccinelli was widely praised for his role in the Huckabee forum. ]]></description>

(Fox News) - The Obama administration told the Supreme Court on Monday night it should stay away from a high-profile challenge to the 2010 health care law until after a lower court has had a chance to review the case. Acting Solicitor General Neal Katyal wrote, &#8220;there is no basis for short-circuiting the normal course of appellate review.&#8221; Katyal also says Virginia Attorney General Ken Cuccinelli&#8217;s case is problematic because he may lack sufficient standing to challenge the health care law. The Supreme Court normally takes cases only after they&#8217;ve been reviewed at least once by appellate judges. Virginia Attorney General Ken Cuccinelli says that&#8217;s not appropriate in this instance. In his filing last month, Cuccinelli said there&#8217;s a &#8220;palpable consensus&#8221; that the high court will ultimately have to pass judgment on the merits of President Obama&#8217;s health care law and should do so without delay. Furthermore, Cuccinelli argues that his case involves &#8220;pure issues of constitutional law&#8221; that appellate judges on the Fourth Circuit U.S. Court of Appeals will be unable to definitively resolve. Katyal says there is no question that the case is of great public importance but uses the language of the court&#8217;s own rules to say it is not &#8220;one of the rare cases that justifies deviation from normal appellate practice and require[s] immediate determination in this court.&#8221; Katyal points out that the Virginia case and several others are already in the pipeline and little time may be saved if the court were to jump in now. 		<description><![CDATA[ From the diaries by Erick In 2012, the people of Virginia will have the opportunity to replace their sitting US Senator, Jim Webb. Webb is a Democrat who had served in the Reagan Administration as his Secretary of the Navy. He wasn&#8217;t in that role for less than a year. Because he refused to reduce the size of the Navy, so he resigned. In 1979, Webb had written an editorial about how women had no place in combat situations . This, unsurprisingly, offended some people. In 2012, the people of Virginia need someone to stare down Webb and recapture this US Senate seat. I think Attorney General Ken Cuccinelli could be that candidate. Cuccinelli is a former State Senator, first elected in a special election in 2002. He was staunchly pro-life, supporting a number of pro-life related regulations. He pushed stricter immigration laws including allowing businesses to sue competitors using undocumented workers and pushed to change state law to establish that the inability to speak English in the workplace is cause for disqualification for unemployment benefits. He pushed for eminent domain reform and fought tax increases / former Governor Warner&#8217;s bloated budget. He&#8217;s an all around conservative that would make the grassroots very happy in Virginia. Then&#8230;let&#8217;s add on his tenure as Attorney General. First, he joined in an amicus brief with a number of other states to help fight the federal government&#8217;s suit against Arizona. Second, he issued a legal opinion stating that police enforcement officials to investigate the immigration status of those they arrest. While the courts did not block the implementation of the law while it works through the court system - this was a big step towards the dismantling of Obamacare. Cuccinelli helped lead the charge - and won the first skirmish of the overall battle against Obamacare. That has made him a grassroots conservative hero, that will provide him with some nationwide momentum going into 2012. Webb voted for Obamacare - and Cuccinelli is the man who struck the first blow against the bill. Cuccinelli can challenge Webb on the constitutionality of the legislation and on the constitutionality of much of the federal legislation that comes through. He can challenge Webb on his misogynistic remarks from the past. He can challenge him with a perfectly conservative record on fiscal issues.
